1. Acceptance of Terms

By accessing the ReemPress website or using the services offered by ReemPress, you agree to be bound by these Terms of Service.

If you do not accept these terms, you must not use the ReemPress website, Hub, or services.

2. Service Description and Eligibility

ReemPress is a platform that allows users to manage certain aspects of their WordPress sites from a simplified interface (the "Hub").

The features offered may evolve, be modified, suspended, or removed. Unless prohibited by law (notably the Quebec Consumer Protection Act for users qualifying as consumers), ReemPress reserves the right to make these changes without prior notice.

You declare that you have the legal capacity to enter into contracts under the laws of your jurisdiction, or that you hold the necessary authorizations to bind the business entity you represent.

3. Beta Version

Certain features of ReemPress may be offered as a beta, preliminary, or experimental version.

These features may contain errors, be modified, suspended, or withdrawn without notice, and may not offer the same level of stability as a final commercial version.

4. User Accounts and Security

Certain features require the creation of an account. You are solely responsible for maintaining the confidentiality of your credentials (password, API keys) and for all activities that occur under your account.

You must provide accurate, complete, and up-to-date information when creating your account. You agree to notify us immediately of any unauthorized use or suspected security breach related to your account.

5. Pricing, Billing, and Renewals

Access to certain features or the Hub requires the purchase of a license or a paid subscription. Prices are indicated in Canadian Dollars (CAD) or US Dollars (USD), as displayed, and exclude applicable taxes.

Automatic Renewal: Unless otherwise specified or cancelled by you prior to the billing date, subscriptions automatically renew for a period identical to the initial term.

Refund Policy: Subject to rights granted by the Quebec Consumer Protection Act (if applicable), fees paid in advance are non-refundable, unless expressly stated otherwise at the time of purchase.

6. Licenses and Access

Certain features of ReemPress require a valid license. Licenses are granted in accordance with the subscribed plan and may be subject to limitations regarding sites, users, or features.

The license granted is non-exclusive, non-transferable, revocable, and limited to the intended use of ReemPress services. Any attempt to bypass, modify, or falsify licensing or security mechanisms will result in the immediate termination of access to the service.

7. Acceptable Use

You agree not to:

• Use the service for illegal or fraudulent purposes;
• Attempt to access ReemPress systems, servers, keys, or data belonging to other users without authorization;
• Disrupt, overload, or compromise the integrity and operation of the service;
• Bypass security, authentication, or license validation mechanisms;
• Use ReemPress to distribute malicious content, viruses, or spyware.

8. Connected Sites and Content Responsibility

You remain solely responsible for the content, maintenance, security, backups, and legal compliance of the WordPress sites connected to ReemPress.

ReemPress acts exclusively as a remote technical management tool and assumes no responsibility for site downtime, local data loss, or content published on your sites.

The user remains responsible for making and maintaining adequate backups of their sites, databases, and content. ReemPress does not guarantee the recovery of lost or deleted data.

9. Service Availability and Maintenance

We strive to maintain service availability 24 hours a day, but we do not guarantee uninterrupted or error-free operation.

Temporary interruptions may occur for technical maintenance, security updates, or force majeure circumstances beyond our control.

10. Intellectual Property

The website, Hub, software, source code, trademarks, logos, visual interfaces, and content belonging to ReemPress are protected by Canadian and international intellectual property laws.

No intellectual property rights are transferred to the user through the use of the service.

11. Third-Party Services

Certain features may depend on services, software, or infrastructure operated by third parties.

ReemPress is not responsible for any interruptions, modifications, limitations, or failures caused by these third-party services.

12. Disclaimer of Warranties

Note: This section may not apply to Quebec residents to whom the Consumer Protection Act applies.

The service is provided on an "as is" and "as available" basis, without any express or implied warranties. ReemPress disclaims all warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

Note: In Quebec, the law does not allow the exclusion of a merchant's liability for their own acts or those of their representatives toward a consumer (Section 10 of the CPA). This clause applies to the fullest extent permitted by applicable law.

To the fullest extent permitted by law, ReemPress shall in no event be liable for any direct, indirect, incidental, special, punitive, or consequential damages (including, but not limited to, loss of profits, data, use, or reputation) arising out of the use or inability to use the service, even if ReemPress has been advised of the possibility of such damages.

To the extent permitted by applicable law, ReemPress's total cumulative liability for any claim related to the services shall not exceed the total amount paid by the user to ReemPress during the twelve (12) months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless ReemPress, its officers, employees, and partners from and against any claims, losses, damages, fines, or expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these terms, or the violation of any third-party rights via your connected sites.

15. Termination and Suspension

We may temporarily suspend or permanently terminate your access to all or part of the service, without prior notice and at our sole discretion, in the event of an actual or suspected violation of these terms, non-payment of applicable fees, or for imperative security reasons.

16. Modifications to the Terms

ReemPress reserves the right to modify these Terms of Service.

For commercial users: Modifications become effective immediately upon publication on this page. Your continued use of the service constitutes your acceptance of the new terms.

For consumers (as defined under the Quebec CPA): A written notice will be sent to you at least thirty (30) days before the modification takes effect. If you refuse these modifications, you have the right to terminate your contract without fee or penalty by sending us a written notice no later than thirty (30) days following the effective date of the modifications.

17. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein.

Any dispute arising out of these terms or the use of the services shall be submitted to the exclusive jurisdiction of the courts sitting in the judicial district of Quebec City, Province of Quebec, Canada, to the exclusion of any other forum.
